Making Funeral Services Plans in Indiana
There are laws in Indiana that state who can make decisions about the final disposition of the departed. Below you will find the people who have the right to make these choices if your loved one did not have any pre-planned arrangements for their services, this list is in the order you must use to decide.

  • The person who was named in a planning declaration
  • A person assigned by power of attorney
  • The surviving spouse of the deceased
  • An adult child of the deceased
  • A Parent
  • The closest living relative

This is the law in Indiana and must be followed, Legacy Cremation Services will be able to help you this before you make any choices on funeral homes or cremation.
Pre-Planning Your Own Services
You can make your own funeral services plans so nothing is left for your loved ones to worry about when the fateful day comes. You can use Indiana's official funeral services planning form and have it signed and dated by yourself and two witnesses. The Indiana law states that the witnesses may NOT be your child, spouse or parent, or a person who is entitled to any part of your estate that is named in your will.
The form you need can be downloaded to your computer for free.
If you serve in the military you can name the person who will make plans for your funeral services using a form provided by the Department of Defense.
When you write down your last wishes do not put them in your will because it may be read weeks after you pass away, it is better to store them in a safe place that your loved ones know about. You can even make copies and distribute them to family and friends. When you do this you can be assured that you will have the funeral services you want in your choice of funeral homes or cremation services.
How Legacy Cremation and Funeral Services Assist Families
When you choose to use Legacy, you can rest assured that we will help you navigate Indiana laws for funeral homes and cremation services whether or not your loved one left a final directive.
Our family or one of our trained professionals will always be available to answer your call no matter what time of year, day or night. We will be able to answer your questions on that first call, or we can come to your home to go over all of the details with you.
We will bring all cremation, funeral homes services, memorials and burial services with you at this time, plus we will go over any cremation costs, or funeral services prices.
After you answer some basic questions and information from you, we will be able to proceed with obtaining the necessary death certificates. The items we will need to begin include;

  • The deceased's birth certificate
  • Social Security number
  • Drivers license
  • Any directive the deceased had for funeral services
  • Life Insurance papers
  • Papers if your loved one was in the military

These items are needed to verify the identity of the departed, and for filing other papers on your behalf.
The papers we will file include life insurance and Social Security benefits. We also make all calls and arrangements for Veterans benefits and burial arrangements for military Vets.
Types of Arrangements for Final Resting
The types of arrangements we at Legacy Cremation Services are cremations and memorial services, funeral services at your choice of funeral homes, religious ceremonies, and burials or scattering of ashes at sea or over land.
When you decide on cremation we handle every aspect of it, from the transportation of the deceased to the crematorium to the return of the ashes. Memorial services are normally what follow a cremation and we can make those plans also. With cremation the memorial does not have to happen near the time of death. If you need to wait for family and friends to arrive, that is possible with cremation but necessarily so with funeral homes or funeral services.
We also take care of all funeral arrangements with funeral homes and make sure that every detail is complete before any services begin.
